The Nelson Law Office P.C. -- Attorneys and Staff

Robert N. Nelson (1946 - 2011) was the firm's founding attorney. Since he established the Law Offices of Robert N. Nelson over 30 years ago, the courts have recognized and specifically cited his skill, professionalism, and knowledge of the law. He was frequently consulted by other attorneys concerning matrimonial matters and received the highest Legal Ability rating and General Recommendations rating in the Martindale Hubbell Law Directory.

Mr. Nelson was an accomplished divorce mediator, having presided over hundreds of mediated settlements. With Mr. Nelson's assistance, more than ninety percent of his clients have been able to resolve their disputes through negotiated settlements rather than contested trials. Mr. Nelson also was a skilled trial lawyer and successfully litigated hundreds of matrimonial matters in the Supreme Court and Family Court of the State of New York, and argued matrimonial appeals before the New York State Appellate Courts.

Prior to opening his own office, Mr. Nelson tried cases as an attorney for the United States Department of Labor, Office of the Solicitor, and served as an Associate Editor of the St. John's Law Review, for which he authored several articles.

Mr. Nelson was admitted to the State Bar of New York and the United States District Court for the Southern and Eastern Districts of New York, and was a member of the Matrimonial and Family Court Law & Procedure Committees of the Nassau County Bar Association. Kimberly I. Nelson

Kimberly I. Nelson graduated from Swarthmore College in 1998 and St. John's University School of Law cum laude in 2002, where she received the CALI Award for Excellence in Family Law. During law school, Ms. Nelson served as the Notes & Comments Editor of the NYLitigator, a journal published by the Commercial and Federal Litigation section of the New York State Bar Association, and as Director of Publications of the Criminal Trial Institute, for which she co-authored "Freeing the Wrongfully Convicted: Lessons from England and the Process in New York," NYSBA Criminal Justice Journal (Winter 2002).

Before joining the Law Offices of Robert N. Nelson, Ms. Nelson prosecuted antitrust class actions as an associate of the law firm Labaton Sucharow & Rudoff LLP in New York City. At Labaton Sucharow, she represented consumers and businesses injured by anticompetitive practices and abuses of market power. The United States District Court for the Northern District of Illinois appointed Ms. Nelson to serve as co-lead counsel for the putative nationwide class in In re Sears, Roebuck & Co. Tools Marketing and Sales Practices Litigation, MDL No. 1703 (N.D. Ill.).

Ms. Nelson currently represents men and women in matrimonial proceedings including divorce and custody actions, and in negotiated matrimonial settlements. She also assists clients in negotiating prenuptial agreements and in the resolution of other family law matters. The results of her most recent appellate work can be read in the decision Bader v. Hazzis, 77 A.D.3d 742, 909 N.Y.S.2d 121 (2d Dep't 2010).

As is the case with the other attorneys in the firm, Ms. Nelson is available to separating and divorcing couples who wish to avoid the cost and anxiety of contested divorce litigation by serving as a mediator or collaborative attorney.

Ms. Nelson is admitted to practice in the state and federal courts of New York and New Jersey. She is a member of the New York City and New York State Bar Associations, the Matrimonial Law and Family Court Law & Procedure Committees of the Nassau County Bar Association, a trained collaborative attorney and former member of the New York Association of Collaborative Professionals, and the International Academy of Divorce Professionals.

James M. Gallagher
Of Counsel

James M. Gallagher is Of Counsel to The Nelson Law Office P.C. Now in his 31st year of practice, Mr. Gallagher was admitted to the New York State Bar in 1981, and studied law at Oxford University in England and the Florida State University College of Law (J.D. 1980). Having earned his undergraduate degree in accounting from the University of New York at Albany (B.S. cum laude, 1977), Mr. Gallagher focused on tax-related legal matters early in his career as an attorney in the tax department at Price Waterhouse. He also has experience with other New York City law firms in the areas of directors' and officers' liability insurance coverage, securities class actions, bankruptcy, and litigation matters.

As an of-counsel attorney to The Nelson Law Office P.C. and its predecessor for the past 25 years, Mr. Gallagher has represented clients in matrimonial litigation before the Supreme and Family Courts in the State of New York. His exacting approach has also assisted clients in estate and probate litigation, as well as in personal injury matters.

Mr. Gallagher additionally maintains his own general legal practice concentrating in bankruptcy under Chapters 7, 11, and 13 of the Bankruptcy Code; real estate; real estate tax certiorari and other tax matters; wills, estates and probate; personal injury matters; and litigation before the New York state and federal courts. He has spoken before the bar association and lectured to community groups on the subjects of reducing real property tax assessments and bankruptcy. He also has been a guest on the radio program, "Law You Can Know."

Mr. Gallagher is admitted to the State Bar of New York, the United States Tax Court, and the United States District Courts for the Southern and Eastern Districts of New York. He also serves on the Nassau County Bar Association Bankruptcy Committee, and is a member of the New York County Lawyers' Association.

Joseph A. Lobosco

Joseph A. Lobosco represents clients at The Nelson Law Office P.C. in hearings, depositions, and contested litigation, as well as in uncontested matrimonial matters.

Mr. Lobosco is a particularly adept litigator, having spent the early part of his twenty-five year career at the Queens County District Attorney’s Office. There, Mr. Lobosco served as a Supervisor in the Intake Bureau, where he worked with police officers and assistant district attorneys in dealing with the processing of new arrests. Subsequently, he specialized as a criminal defense attorney prior to joining The Nelson Law Office P.C. He has defended hundreds of clients, and has tried over thirty cases in the past ten years. Accordingly, his expertise is of particular value to clients finding themselves embroiled in family offense and criminal-related family matters.

Mr. Lobosco graduated from St. John’s University in January of 1986 with a degree in Communication Arts and St. John’s University School of Law in June of 1989. While in attendance at St. John’s Law School, Mr. Lobosco served as the Academic Vice-president of the Student Bar Association. He is admitted to practice in New York State, the Southern and Eastern District of New York Federal Courts, and is a member of the New York State Bar Association.

In addition to representing clients in family and matrimonial matters, Mr. Lobosco continues to handle criminal matters.
